Please read these Terms of Service carefully before using Humongous. By accessing or using our service, you agree to be bound by the terms set out below. If you do not agree to any part of these terms, you must not use the service.
These Terms of Service ("Terms") constitute a legally binding agreement between you and Humongous (referred to as "Humongous," "we," "us," or "our"). By creating an account, accessing the dashboard, installing our integration, deploying our code to a Roblox game, or otherwise using any part of the Service (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.
If you are using the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. If you do not have such authority, or if you do not agree with these Terms, you must not use the Service on behalf of that entity.
You must meet all of the following requirements to use the Service:
The Service is intended for users who own, operate, administer, or moderate Roblox games. You must comply with the Roblox Terms of Use and Developer Terms at all times while using the Service.
To use certain features of the Service, you must create an account through the Discord OAuth authentication flow and, where applicable, link an associated Roblox account. You agree to provide accurate, current, and complete information during registration and to keep that information updated.
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with this section, including any loss resulting from the unauthorized use of your account.
The Service may provide you with API keys, webhooks, or other credentials used to connect the Service to your game. You agree to keep all such credentials confidential and to not share them publicly or with any third party. You are responsible for all actions taken using your credentials, including any misuse.
Humongous provides a suite of professional moderation tools for Roblox games, including but not limited to: chat logging and retrieval, player reports, warnings, bans and mutes, flagged word monitoring, server lists, custom roles and permissions, Discord integration, and related analytics and management features.
We may add, modify, or remove features at any time. We reserve the right to change, suspend, or discontinue any aspect of the Service (in whole or in part) at any time and for any reason, with or without notice. We will not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
While using the Service, you agree not to:
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal, non-commercial or commercially legitimate game moderation purposes, solely as intended by the Service.
The Service, including all software, code, dashboards, documentation, graphics, algorithms, logos, trademarks, and other materials, is proprietary to Humongous and its licensors. All right, title, and interest in and to the Service remains with us and our licensors. All rights not expressly granted in these Terms are reserved.
Any code we provide to connect the Service to your Roblox game is made available to you under these Terms to enable your use of the Service. You may implement this code in your own games, but you may not redistribute, resell, republish, reverse engineer, or incorporate it into any competing service or product. Any unauthorized use constitutes a breach of these Terms.
You retain all rights to the data and content that you provide, upload, or submit to the Service, including game data, configuration settings, and any text or media you enter. You grant us a limited license to host, process, and use this data solely to provide and improve the Service as described in our Privacy Policy.
The Service processes game-related data such as chat logs, player reports, moderation actions, and flags generated by your game's use of the Service. You represent and warrant that you have the rights and consents necessary to provide this data to us and to process it through the Service, including any consents required from players under applicable privacy laws.
Certain aspects of the Service may require payment or the acceptance of a subscription or custom pricing agreement. Any fees are described to you prior to purchase. All fees are non-refundable except as otherwise required by law or as we may elect at our sole discretion.
We may change our pricing from time to time. We will provide reasonable notice of any material changes. Continued use of the Service after such changes constitutes acceptance of the new pricing. If you have questions about billing, you may contact us via our Support Discord.
We may terminate or suspend your account and access to all or part of the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms or for misuse of the Service. Upon termination, your right to use the Service will cease immediately, and data associated with your account may be deleted as described in our Privacy Policy.
You may discontinue your use of the Service at any time. To request deletion of your account or associated data, please contact us. Sections that, by their nature, should survive termination (including but not limited to license restrictions, ownership, disclaimer of warranties, limitation of liability, and indemnification) shall survive any termination.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE MAKE NO WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS. ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM SUCH ACCESS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HUMONGOUS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100.00). THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE OR EXTEND THIS LIMIT.
You agree to defend, indemnify, and hold harmless Humongous and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party, including but not limited to intellectual property or privacy rights; or (d) any data you provide or submit through the Service.
The Service may integrate with or rely on third-party services, including Discord and Roblox. Your use of those services is subject to their respective terms of service and privacy policies. We do not control and are not responsible for any third-party services. We make no representations or warranties regarding any third-party services and disclaim all liability arising from your use of them.
We respect the intellectual property rights of others and expect our users to do the same. If you believe that any content or material on the Service infringes your copyright, you may submit a notice to us in accordance with the Digital Millennium Copyright Act (DMCA) containing the required information: identification of the copyrighted work, identification of the infringing material and its location, your contact information, a statement of good faith belief, and a statement that the information is accurate, under penalty of perjury.
We may terminate the accounts of users who repeatedly infringe the intellectual property rights of others.
We may revise these Terms from time to time. The most current version will always be posted on this page, and the "Last updated" date at the top will be revised accordingly. If a revision, in our sole discretion, is material, we will notify you via the Service or by other reasonable means. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the federal and state courts located within the State of New York for the resolution of any disputes arising out of or relating to these Terms or the Service.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Humongous regarding the Service and supersede all prior agreements and understandings. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
